The petitioner has approached this Court seeking grant of regular bail in respect of a case registered vide FIR No.154, dated 20.11.2020, Police Station STF, Phase-4, SAS Nagar, Mohali, under Section 22/61 of Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 207 of Motor Vehicle Act.

The case of the prosecution is that the petitioner alongwith co-accused Kewal Singh was apprehended on the basis of secret information while they were traveling in a car and 72000 intoxicant tablets containing 'tramadol hydrochloride' were recovered.

Learned counsel for the petitioner submits that since identically situated coaccused, who was also apprehended at the spot alongwith the petitioner i.e. PANKAJ KAKKAR 2022.10.17 18:02 I attest to the accuracy and authenticity of this document

( 2 ) CRM-M-23999-2021 (O&M) Kewal Singh has already been granted bail by this Court vide order dated 21.5.2021 passed in CRM-M-18986 of 2021, the petitioner, who otherwise has a clean record, also deserves the same concession on grounds of parity. 4.

Opposing the petition, learned State counsel has submitted that the complicity of the petitioner is clearly evident inasmuch the car from which the recovery was effected and which was being driven by the petitioner belongs to the petitioner himself. Learned State counsel has, however, informed that the petitioner as on date has been behind bars since the last more than 1 year and 10 months and is otherwise not involved in any other case. It has also been informed that out of the cited 17 PWs only 5 PWs have been examined. Learned State counsel has not disputed the fact that the coaccused Kewal Singh has been granted bail by this Court. 5.

This Court has considered the rival submission and have also perused the order dated 21.5.2021 passed in CRM-M-18986 of 2021 vide which the coaccused Kewal Singh had been granted bail. 6.

In view of the aforestated position, the petitioner, who otherwise has a clean record, certainly deserves the same concession on grounds of parity.
