PANKAJ JAIN, J. (ORAL) This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case F.I.R. No.02 dated 03.01.2023, registered for the offences punishable under Sections 379, 411 of the IPC at Police Station Division No.6, Jalandhar.

Custody Certificate of the petitioner has been produced today in Court. The same is taken on record.

FIR (Annexure P-1) came into being qua theft of motorcycle which was later on recovered from the petitioner and offence punishable under Section 411 IPC was added. Counsel for the petitioner submits that at the most petitioner would be liable for offence punishable under Section 411 IPC. Recovery already stands effected and no useful purpose will be served by prolonging the incarceration of the petitioner. Counsel for the State does not dispute that the investigation already stands concluded and recovery stands effected. 5.

Without commenting on the merits of the case, keeping in view the incarceration already suffered by the petitioner and the fact that the investigation already stands concluded and Challan stands presented, the present petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the Trial Court/Duty Magistrate concerned.
