-.- KARAMJIT SINGH , J. (Oral) Prayer is for grant of anticipatory bail in case having FIR No.18 dated 23.4.2022 registered under Section 21(1) of Mines and Mineral (Development and Regulations) Act at Police Station Hajipur, District Hoshiarpur.
Counsel for the petitioner submitted that the petitioner has joined investigation with the police in the light of previous order dated 25.5.2022 passed by this Court.

( 2 ) CRM-M-21752-2022 Status report by way of affidavit of ASI Rajinder SinghInvestigating Officer filed on behalf the respondent-State is ordered to be taken on record.
State counsel on instructions ASI Rajinder Singh has not disputed the aforesaid assertions made by counsel for the petitioner and further submits that the petitioner who has also associated with the investigation is not required for further investigation or for custodial interrogation. The State counsel further submits that the recoveries have already been effected in the present case and police is going to present the challan immediately after conclusion of the investigation. In view of the above and without commenting on the merits of the case, present petition is allowed and order dated 22.05.2022 is hereby made absolute subject to the condition that the petitioner has to furnish undertaking in writing in the shape of affidavit to the Investigating Officer that in future he will not indulge in any illegal activity of mining anywhere in the area of Punjab.
The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
