IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-39293 of 2018 Date of Decision: 13.09.2018 Jagtar Singh alias Sira and another ....Petitioners

Versus

State of Punjab ....Respondent CORAM: HON'BLE MR. JUSTICE RAMENDRA JAIN Present: - Mr. Amit Kumar Walia, Advocate, for the petitioners. Mr. Amandeep S. Gill, DAG, Punjab.

RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioners Jagtar Singh alias Sira and Avtar Singh in a case arising from FIR No.75 dated 11.07.2018 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Longowal, District Sangrur. According to the prosecution, 08 and 07 injections of Buprenorphine I.P. Omgesic were recovered from petitioner No.1 and No.2, respectively.

Learned counsel for the petitioner inter alia contends that petitioners are in custody since 10.07.2018. No recovery has to be effected from them. Conclusion of trial may take a sufficient long time. No useful purpose would be achieved by detaining the petitioners in jail any more. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioners.

Considering overall facts and circumstances, but without RAVINDER SINGH 2018.09.13 18:18 I attest to the accuracy and authenticity of this document expressing any opinion on the merits of the case, the petition is allowed.

-2CRM-M-39293 of 2018 Petitioners are ordered to be released on bail, on their furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
