(Oral) Petitioners Neetu and three minor daughters Riya, Manvi and Rudrika in this invocation have challenged impugned orders dated 8.3.2019 of the court of learned Principal Judge, Family Court, Gurugram whereby the court below while disposing of application for interim maintenance by the present petitioners then applicants had directed the respondent-husband to pay maintenance to the wife at the rate of Rs 5000/- per month and at the rate of Rs 3000/- per month to each of the three daughters. The petitioners have sought to assail the inadequacy of this.

Criminal Revision (F) No. 267 of 2019 -2The contentions that have sought to be raised by learned counsel for the petitioners that it ought to have been on the higher side is no where corroborated from the records when admittedly the husband is working as Nursing Attendant in Safdurjung Hospital, New Delhi and his gross salary is proven to be around Rs 50,000/- per month. The claim of the rental income or from other sources is not at all brought on the record by any means and apparently are mere averments of the applicant-petitioners. Keeping in view this prima facie evidence as to the earnings of the husband the court has rightly concluded and awarded the interim maintenance amounts and the counsel for the petitioners could not convince how the same was apparently on the lower side contrary to the what was brought on the records.

The husband too needs money for his up-keep and maintenance and thus having been awarded in all maintenance of Rs 14,000/- per month is adequate amount at this juncture. There being no illegality apparent in the findings, the present petition is dismissed in limine.
