Instant petition has been filed under Section 482 Cr.PC for quashing of FIR No.13 dated 01.02.2023 registered under Sections 419, 420, 467, 468, 471 and 120-B IPC at Police Station DLF PH-II Gurugram. 2.

Learned counsel for the petitioner submits that a false and fabricated case has been planted upon the petitioner and a perusal of the FIR in question (Annexure P-1) leaves no manner of doubt that the dispute, if any, between the complainant and co-accused Narpinderjeet was essentially of a civil nature. Learned counsel further submits that the petitioner has been implicated in the case in hand only because he was a care taker of the house of the main accused Narpinderjeet. Learned counsel still further submits that the whole incident had happened within the territory of Panchkula, hence, the Police Station DLF-II had no jurisdiction to entertain the complaint in question. 3.

Heard learned counsel for the petitioner and perused the relevant material on record.

On a pointed query put to the learned counsel qua the stage of trial, he has apprised the Court that the investigation is still underway. 5.

In the aforesaid circumstances, since the matter is still under investigation, this Court would loathe to quash the FIR at such a nascent stage. When the investigation is in progress, the Courts cannot delve into the merits or otherwise of the allegations levelled in the FIR and the police must be permitted to complete investigation as investigation of a crime falls within the exclusive domain of the investigating agency. 6.
