 "#$ !% Allegations against the petitioner Parmod Kumar in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.58 dated 08.06.2015 registered at Police Station Julkan, District Patiala under Section 15/61/85 of the Narcotic Drugs and Psychotropic Substances Act, 1985, are that on 08.06.2015 he was apprehended leading to recovery of 40 kg of poppy husk, a non9 commercial quantity.

   bail vide an order of this Court dated 14.09.2015 and that the petitioner has already undergone incarceration for a period of 5 months, could not be controverted by learned State counsel. In view of the principle of parity, taking into consideration the submissions made by counsel for the petitioner coupled with the fact that the trial will take a long time to conclude, this Court is of the opinion that further detention of the petitioner in the present case is not warranted. Accordingly, he is ordered to be released on regular bail to the satisfaction of Chief Judicial Magistrate/ Duty Magistrate, Patiala.
