(ORAL) Feeling aggrieved against the impugned order dated 17.10.2015 passed by the learned Additional District and Sesions Judge, (Family Court), Ambala, transferring the execution petition of the petitioner to the learned District Judge, Yamuna Nagar at Jagadhari, petitioner-wife has approached this Court by way of instant criminal revision petition.

Learned counsel for the petitioner, at the very outset, fairly states that so far as transfer of the execution petition is concerned, the impugned order has been passed certainly in the interest of the petitioner herself. However, he submits that learned Family Court ought to have granted a reasonable amount to the petitioner towards litigation expenses. Criminal Misc. No. M-38407 of 2015 petition with liberty to the petitioner to move an appropriate application before the learned court at Jagadhari claiming reasonable amount towards litigation expenses and it may be directed to pass an appropriate order.

Having heard learned counsel for the petitioner and after careful perusal of record of the case, this Court is of the considered opinion that petitioner has got every right to seek appropriate relief from the leaned court at Jagadhari. It goes without saying that if an appropriate application is moved by the petitioner claiming any kind of relief, learned trial court shall consider and decide the same passing an appropriate order thereon, in accordance with law. With the abovesaid observations made and directions issued, present petition stands disposed of.
