The present writ petition has been filed under Article 226/227 of the Constitution of India for issuance of an appropriate writ or order in the nature of mandamus directing the respondents to decide the representation dated 21.11.2025 (Annexure P-9) and to comply with the joining letter dated 31.10.2025 (Annexure P-7). Further praying for allowing the petitioner to join duties during the pendency of criminal trial arising out of FIR No.90 dated 16.08.2024 registered under Sections 304, 126(2), 115(3) and 3(5) of BNS 2023 at Police Station Bahaw Wala, District Fazilka

without subjecting him to any departmental inquiry, as the action of respondents is illegal, arbitrary and violative of Articles 14 and 16 of the Constitution of India and the principles of natural justice. 2.

Learned counsel appearing for the petitioner at this stage submits that she would be satisfied if a direction is issued to respondent No.3 to decide the representation dated 21.11.2025 (Annexure P-9) by passing a speaking order in a time bound manner. 3.

Notice of motion.

Mr. Vikas Arora, learned Deputy Advocate General, waives service of notice on behalf of the respondents-State, whereas Mr. Harkirat Singh Randhawa, Advocate put in appearance on behalf of respondent No.3 and filed memo of appearance on behalf of respondent No.3, which is ordered to be taken on record. Registry is directed to place the same at an appropriate place. They submit that they have no objection in case a direction is issued to respondent No.3 to hear and decide the representation dated 21.11.2025 (Annexure P-9) in a time bound manner. 5.

In view of the limited prayer made by counsel for the petitioner without commenting upon the merits of the case, the present petition is disposed of and respondent No.3 is directed to hear and decide the representation dated 21.11.2025 (Annexure P-9) filed by the petitioner in a time bound manner and pass a speaking order, within a period of two months from the date of receipt of certified copy of this order.

Needless to say, if the petitioner is found entitled to the relief sought, the same be granted to him forthwith by respondents/competent authority.

Pending miscellaneous application(s), if any, shall also stands disposed of.
