**** RAJ MOHAN SINGH, J.(ORAL) The petitioner has preferred this writ petition for the issuance of an appropriate writ in the nature of mandamus directing the respondent No.3 (The Secretary, RTA, Ferozepur) to pass an order of replacement of bus No. PB-05-D-9815(1996 model) with another bus No PB-05-T-9815(2011 model) on permit No.855/Reg/M/RTA/F/03 on Ferozepur to Mallawala route.

Learned counsel for the petitioner submits that for want of replacement of the old bus with new bus, the permit of the petitioner is lying unutilized and the petitioner and travelling public are suffering. 2023 PHHC:059184 CWP No.8698 of 2023 -2has repeatedly filed representations on 20.06.2022 and 18.07.2022 for replacement of her old bus with comparatively new bus for operation of the same on the earmarked route on the permit granted to the petitioner by the competent authority. At this stage, learned counsel for the petitioner submits that the latest representation of the petitioner dated 18.06.2022 has not been adverted to by the competent authority so far and the petitioner would be satisfied in case a direction is issued to the competent authority/respondent No.3 to take note of the pending representation and pass an appropriate order in accordance with law in a time bound manner.

On the asking of the Court, Mr. Sanjeev Soni, Addl. A.G., Punjab accepts notice on behalf of the respondents. In view of the nature of prayer, I deem it appropriate to dispose of this writ petition at this stage by directing the respondent No.3 to decide the pending representation of the petitioner dated 18.07.2022 in accordance with law preferably within a period of one month from the date of receipt of certified copy of this order.
