(Oral) This is a petition for the grant of regular bail in case bearing FIR No. 158 dated 27.08.2014, under Sections 308, 323, 506, 34 IPC, (Offence under Section 302 IPC was added later on), registered at Police Station Samana, District Patiala. Learned counsel has argued that the petitioner has now been in custody since 02.09.2014. Learned Addl.AG states that out of 24 witnesses, 8 have been examined,4 have been given up and 12 official witnesses remain to be examined and the prosecution undertakes to conclude its evidence on or before 15.03.2016(subject to the fact that the petitioner does not obstruct the same).

CRM-M-38431-2015(O&M) -2In these circumstances this petition is dismissed at this stage but it is directed that in case the prosecution evidence is not concluded by 15.03.2016(subject to the petitioner not obstructing the same)the trial Court shall release the petitioner on bail to its satisfaction.
