Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 59 dated 24.3.2015 under Section 18 of Narcotic Drugs and Psychotropic Substances Act, 1985 ('Act' for short), registered at Police Station Division No. 7 (Vardhman), Ludhiana City. As per the prosecution case, petitioner was found in possession of 07 grams of opium while in custody. Petitioner has already undergone sentence of rigorous imprisonment for six months in FIR No. 144 dated 26.7.2011 under Section 15 of the Act, registered at Police Station Sadar Jagraon. In the present case, petitioner is in custody for more than 07 months. Challan has already been presented in the Court and conclusion of trial may take time.
Keeping in view the fact that the petitioner was found in possession of small quantity of the contraband and is in custody GURPREET SINGH 2015.12.08 15:41 I attest to the accuracy and authenticity of this document chandigarh
Crl. Misc. No. M-38433 of 2015 -2for the last about 07 months, it would be just and expedient to order the release of the petitioner on bail.
