Learned counsel for the petitioners submits that though the petitioners were working under the Swasthya Kalyan Samiti (SKS), which scheme is not covered by Haryana Rozgar Kaushal Nigam, but the petitioners are working for the last nine years on the post of Pharmacists still they were not allowed to continue, hence, the respondents-administration be directed to take a lenient view as to whether the petitioners are to be allowed to continue in service or not.

Learned counsel for the petitioners further submits that the posts, against which the petitioners were working are still lying vacant and work of the said post still exists, hence, the respondents be directed to reinstate the petitioners on the said posts on which they were discharging their duties.

Learned counsel for the respondents submits that in case, any such claim is raised by the petitioners by filing of a representation before the administrative department/authorities concerned, the same will be considered and an appropriate speaking order will be passed by the authority RIYA 2024.02.13 11:29 I attest to the accuracy and integrity of this document

Learned counsel for the respondents further submits that if the department concerned is of the view that the posts on which the petitioners were discharging their duties are still lying vacant and the work of the said posts needs to be performed and the scheme under which the petitioners were appointed is also continuing, an appropriate speaking order will be passed otherwise due reasons for not accepting the claim of the petitioners will be given in the speaking order.

Learned counsel for the petitioners submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed, at this stage, with liberty to file a representation with respondents so as to raise all the claims as raised in the present petition.
