On 28.04.2023, this Court had passed the following order:- "Present petition has been filed under Section 438 Cr.P.C. seeking concession of anticipatory bail to the petitioner in case of FIR No.134 dated 22.09.2021 registered under Sections 302, 323, 506, 148, 149 IPC at Police Station Bahaw Wala, District Fazilka, Punjab.
Learned counsel contends that initially the petitioner was named in the FIR, but during investigation, he was found to be innocent and kept in column No.2 in the final report presented under Section 173 CrPC. However, on an application moved by the prosecution under Section 319 CrPC, he has been summoned to face trial.
Notice of motion.
Mr. Manipal Singh Atwal, DAG Punjab, accepts notice on behalf of the State and seeks time to obtain instructions. The petitioner is directed to appear before the trial Court on or before 05.05.2023 and furnish his bail/surety bonds. On so doing, he be released on bail.
Adjourned to 10.07.2023. "

Learned counsel submits that in pursuance of aforesaid order, the petitioners surrendered before the trial Court and is being represented through his counsel. Copy of the orders dated 20.05.2023, 30.06.2023 and 03.08.2023 affirming the aforesaid, have been produced in Court and the same is taken on MOHIT 2023.08.28 10:54 I attest to the accuracy and authenticity of this order/judgment

Learned State counsel on instructions from ASI Satpal Singh affirms that aforesaid factum.

In view of the above, order dated 28.04.2023 is hereby made absolute, subject to compliance of conditions as specified under Section 438(2) Cr.P.C.
