(Oral) The petitioner prays for grant of bail in anticipation of arrest in FIR No.210 dated 03.09.2017 registered under Sections 379 IPC and 21 of the Mining and Minerals Act, 1957 at Police Station Meharban, District Ludhiana.

Counsel for the petitioner submits that the Additional Sessions Judge, Ludhiana vide order dated 04.10.2017 has dismissed the bail application of the petitioner on the statement made by ASI Suresh Kumar that the petitioner, at this stage, is not nominated in the investigation and is not required. Counsel for the petitioner further submits that the police is still raiding his house for arresting him. In view of the above, the present petition is disposed of with a direction to the Investigating Officer to issue a notice for 07 days, in case the petitioner is nominated in the investigation.
