M.M.S. BEDI, J. (ORAL) This order will dispose of the above noted two petitions i.e., one filed by Balwinder Singh and another by Balbir Singh, for the grant of pre-arrest bail in a case which was registered
CRM-M-3854-2015 (O&M) at the instance of Satnam Singh and Ashok Kumar alleging that they had entered into an agreement of sale for the purchase of a plot measuring 200 sq. yards for a sale consideration of Rs.8500/- per sq. yard with one Aarti Sood and paid a sum of Rs.6 lacs as earnest money. This deal was struck through the petitioners and one Vikram Singh as property dealer with one lady who impersonated Aarti Sood, the alleged owner of the property. A perusal of the police file indicates that merely on the basis of the oral allegations without there being any agreement of sale, the petitioners have been involved in the case. They have joined investigation.
Without prejudice to the rights of the parties to settle the money dispute amongst themselves, both the petitions for pre arrest bail can be allowed.
The petitions are allowed. It is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer subject to the conditions that they will join investigation as and when required and will not tamper with the evidence or hamper investigation, in any manner.
