IN THE HIGH COURT OF PUNJAB & HARYANA, CHANDIGARH

Sr. No.: 117 Civil Writ Petition No.9427 of 2024 Date of Decision: May 08, 2024 Deepika Kalyan ..... PETITIONER(S)

VERSUS

State of Haryana & others ..... RESPONDENT(S) . . .

CORAM:

HON'BLE MR. JUSTICE TRIBHUVAN DAHIYA . . .

PRESENT: - Mr. Amandeep Bidhan, Advocate, for the petitioner. Ms. Tanushree Gupta, Deputy Advocate General, Haryana.

. . .

Tribhuvan Dahiya, J (Oral) The petition has been filed, inter alia, seeking a writ of certiorari quashing the provisional allotment letter dated 18.10.2023, Annexure P-5, whereby the petitioner, who is working as Primary Teacher (PRT), has been allocated District Karnal.

2.

As per averments in Para 7 of the petition, the teachers lower in merit to the petitioner, who were working in District Kaithal, were allocated the same district as their first preference, whereas the petitioner despite being higher in merit was shifted to Karnal, ignoring her first preference for Kaithal.

3.

Learned State counsel, on instructions and citing a printout of preferences given by the petitioner, submits that the assertion is factually incorrect. As per the last and final preferences given by the petitioner on AVIN KUMAR 2024.05.10 12:09 I attest to the accuracy and integrity of this judgment/order.

CWP No.9427 of 2024 [2] 15.10.2023 at 06.49 PM, she opted for Karnal as the first preference, and was accordingly allocated the district.

4.

Learned counsel for the petitioner is not in a position to dispute these facts, which shows the petition is based on wrong averments, and there is no merit in the claim raised.

5.

In view thereof, there is no ground to entertain the petition. 6.

Dismissed.
