Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.67 dated 17.08.2018 under Section 420 IPC and Section 13 of Prevention of Human Smuggling Act, registered at Police Station Anaj Mandi, District Patiala. I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that FIR in the present case, has been registered on the statement of Sanjeev Kumar. The allegations in the FIR are that present petitioner had taken `7.50 lakhs from the complainant for sending him, his relatives and friends to foreign country and has thus cheated the complainant. It is also in the FIR that Namnit Singh handed over a cheque on 01.03.2017 of `1,40,000/- but it was also bounced. CRM No.M-39541 of 2018 -2and in view of the serious allegations against the present petitioner and he being the main accused, I find that petitioner is required for custodial interrogation and no ground is made out for grant of anticipatory bail to him.
Therefore, finding no merit in the present petition, the same is dismissed.
