Petitioner prays for anticipatory bail in FIR No.164 dated 03.10.2014, under Section 25 of the Arms Act, 1959, registered at police station Civil Lines Bathinda, District Bathinda.
It is contended that the recovery of alleged pistol and cartridges has been effected from co-accused Sarabjit Singh @ Raju. There is nothing to connect the petitioner with the alleged offence except the statement made by OMKAR SINGH 2015.01.30 12:02 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-38673 of 2014 [2] Sarabjit Singh @ Raju while in custody. There is no other case pending against the petitioner and he is not a previous convict. Pursuant to order dated 20.11.2014, petitioner is stated to have joined investigation. Learned counsel for the State, on instructions from ASI Raghbir Singh, submits that the petitioner has indeed joined investigation and he is no longer required for custodial interrogation. There is no other case pending against the petitioner.
There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. In view of the above but without commenting or expressing any opinion on the merits of the case, order dated 20.11.2014 is made absolute. Petition is allowed.
