(Oral) This is an application for regular bail in case bearing FIR No.132 dated 08.12.2012, registered under Sections 363, 366, 376 IPC and Section 3/4 of the Protection of Children from Sexual Offences Act, 2012 at Police Station Fatehgarh Churian, District Gurdaspur.

Learned counsel states that the petitioner has been in custody for 2 years and 10 months. Learned DAG states that it is a very serious offence where this man enticed away the minor girl of his neighbour. He, on instructions from ASI Gurdev Singh, states that out of 16, 11 witnesses have been examined and the remaining 5 witnesses are official witness who have all been summoned for the next date i.e. 08.12.2015 and the prosecution undertakes to conclude its evidence within one month (subject to the fact that the petitioner does not obstruct the same).

CRM-M-38585-2015 -2In these circumstances this petition is dismissed at this stage but it is directed that in case the prosecution evidence is not concluded on or before 24.12.2015(subject to the petitioner not obstructing the same) the trial Court shall release the petitioner on bail to its satisfaction.
