RAJBIR SEHRAWAT, J (ORAL) Prayer in this petition is for grant of interim anticipatory bail in case FIR No.533 dated 17.9.2017 under Sections 323,341,379-A, 506,34 IPC, P.S City Palwal, District Palwal (later on offence under Section 379-A IPC was deleted and 379-B IPC added).

It is contended by learned counsel for the petitioner that the petitioner has falsely been roped in at the instance of the complainant. In fact, there was a business dealing between the complainant and one Sajid along with the petitioner in partnership. However, the business could not take off properly as a result of which the complainant is still to return Rs.4 lacs to the petitioner and his partner Sajid. This fact has been so admitted by the complainant before a Panchayat of respectables. Learned State counsel, on instructions from ASI Om Parkash, submits that the petitioner has since joined the investigation and he is no longer required for further custodial investigation by the police. It being so, the interim bail granted to the petitioner vide order dated 11.9.2018 is made absolute, subject to his fulfilling conditions under Section 438 (2) Cr.P.C.

The petition stands allowed accordingly.
