Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.91 dated 16.10.2012 under Sections 406, 498-A IPC registered at Police Station Women Cell, District Ludhiana.

I have heard learned counsel for the petitioners and have gone through the record.

As per the order dated 19.09.2014 passed by learned Addl. Sessions Judge, Ludhiana accused-applicants Kiran, Jagmal Singh and Hari Krishan were granted concession of interim anticipatory bail vide order dated 21.07.2014 and they were directed to join investigation within three days of the passing of order. Again the Court adjourned the case to 19.09.2014 and the applicants were again directed to join investigation. CRM No.M-3861 of 2015 -2suffered statement that the applicants have not joined the investigation in this case. Therefore, the anticipatory bail application was dismissed by learned Addl. Sessions Judge, Ludhiana. The perusal of the order dated 19.09.2014 shows that learned Addl. Sessions Judge, Ludhiana has already granted interim anticipatory bail to the petitioners but they have not joined the investigation and have not complied with the terms and conditions of interim bail granted to them.

When the petitioners themselves have not complied with the terms and conditions of the interim anticipatory bail granted to them by learned Addl. Sessions Judge, Ludhiana, now no case is made out to grant anticipatory bail to the petitioners. Therefore, finding no merit in the present petition, the same is dismissed.
