(PROCEEDINGS THROUGH V.C.) AUGUSTINE GEORGE MASIH, J. (ORAL) Petitioner has approached this Court with a grievance that he being the Sarpanch has been placed under suspension by Deputy Commissioner, Kaithal, vide order dated 02.07.2020 (Annexure P-11). Appeal against which has been filed by the petitioner before the Financial Commissioner. The said appeal has not yet been decided and the respondents are insisting upon taking over the charge of the post of Sarpanch from the petitioner. Counsel for the petitioner contends that prior to the decision of the appeal or the application for stay, which has been preferred in the appeal, the charge of the post of Sarpanch be not taken from the petitioner.

Counsel for the State submits that she has received instructions that the appeal of the petitioner will be decided within a period of one month by giving him an opportunity of being heard. In the light of the statement of the counsel for the State, the present petition is disposed of with an observation/direction that till the decision on the application for stay or the appeal, whichever is earlier, the

CWP No.10164 of 2020 order of suspension dated 02.07.2020 (Annexure P-11) shall be kept in abeyance.
