Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.0327 dated 29.08.2017 under Sections 302, 201, 34 IPC and Section 25 of the Arms Act, registered at Police Station Rajendra Park, District Gurugram.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per prosecution version, complainant Pardeep got registered the FIR that his brother Sachin has been VINEET GULATI 2019.03.20 17:00 I attest to the accuracy and authenticity of this document Chandigarh killed. During investigation, present petitioner along with other co-accused

CRM No.M-39606 of 2018 -2has been nominated and attribution to the present petitioner is that he fired a shot on the head Sachin. The weapon has also been recovered from the petitioner.

Though, as per FSL report, no definite opinion can be formed that bullet and empty were fired from the weapon recovered from the petitioner, but keeping in view the nature and gravity of the offence and also in view of the fact that there is every apprehension that petitioner may tamper with the evidence, I find that no ground is made out for granting benefit of regular bail to the petitioner.

Therefore, finding no merit in the present petition, the same is dismissed.
