R.P. NAGRATH, J. (ORAL) This petition under Section 438 Cr.P.C. has been filed by the petitioner seeking anticipatory bail in FIR No. 13 dated 13.06.2014 registered under Sections 406/498-A of the Indian Penal Code at Police Station Women Cell, District Ludhaina.

When this case was listed on 06.02.2015, following order was passed:- "Learned counsel for the petitioner contends that the parties were married on 24.9.2012. The petitioner filed a petition under Section 9 of the Hindu Marriage Act, 1955, on 18.2.2014 and thereafter, the present FIR was registered on 13.6.2014 as a counter-blast. It is stated that the recovery has already been effected RISHU KATARIA 2015.04.24 17:49 I attest to the accuracy and authenticity of this document

CRM-M-3864-2015 -2and the petitioner is even ready to rehabilitate the wife. Notice of motion for 27.3.2015.

In the meanwhile, the petitioner is directed to join the investigation. In the event of arrest of the petitioner, he will be released on interim bail to the satisfaction of the Arresting Officer, subject to compliance of conditions contained in Section 438(2) Cr.P.C."

On instructions from ASI Jasbir Singh, learned State counsel submits that petitioner has joined the investigation on 17.02.2015. It is further submitted that one gold ring and one gold chain are yet to be recovered from the petitioner otherwise rest of the recoveries have been made.

For that purpose, the petitioner is directed to again appear before the Investigating/Arresting Officer on 01.05.2015 at 11.00 a.m. and directed to co-operate with the investigation. In view of the above and without expressing any opinion on merits of the case, the instant petition is allowed and the interim bail granted to the petitioner vide order dated 06.02.2015 is made absolute and the petitioner shall abide by the conditions as enshrined in Section 438 (2) Cr.P.C.

In case the petitioner fails to appear before the Investigating/Arresting Officer on 01.05.2015 at 11.00 a.m., the concession of pre-arrest bail shall automatically stand vacated.
