HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.41 dated 03.04.2020 under Sections 21/25/29/61/85 of NDPS Act (Section 473 IPC added later on) registered at P.S Sidhwan Bet, District Ludhiana. As per allegations in the FIR, 1 kg 500 grams of heroin besides currency notes worth Rs.16,80,000/- were recovered from a car XUV 500 Mohindra in which co-accused Satnam Singh, Lavpreet Singh and Satvir Singh were travelling. Name of the present petitioner has figured in the disclosure statement made by co-accused Satnam Singh that they along with the present petitioner used to purchase heroin from Nigerian of Delhi. Learned counsel for the petitioner contends that there is no other criminal case registered against the petitioner and that he has been named on the basis of disclosure statement made by the co-accused.

It is contended that the recovery effected from the petitioner is only 100 grams heroin and that the petitioner is in custody since 01.05.2020. Opposing the petition, the learned State counsel has submitted that the investigation is complete and the challan has been presented. Without commenting anything on the merits of the case and MANOJ KUMAR 2020.10.

Crl.M.No.19453 of 2020 #2# also bearing in mind the custody period of the petitioner, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Tejinder Sharma @ Tanu is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
