"#$ !% Allegations against the petitioner Sohan Lal in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.87 dated 05.06.2015 registered at Police Station Morinda, District Rupnagar under Section 22/61/85 of the Narcotic Drugs and Psychotropic Substances Act, 1985, are that on 05.06.2015 he was apprehended leading to recovery of 500 ml of Codeine Phosphate, an intoxicant, a non9commercial quantity.

Contentions of the learned counsel for the petitioner that the petitioner is in custody since 05.06.2015 could not be controverted by learned State counsel.
Keeping in view the incarceration undergone and the submissions made by counsel for the petitioner coupled with the fact that the trial will take a long time to conclude, this Court is of the opinion that no useful purpose will be served by keeping the petitioner behind bars in the present case. Accordingly, he is ordered to be released on regular bail to the satisfaction of Chief Judicial Magistrate/ Duty Magistrate, Rupnagar.
