(Oral) The petitioner prays for grant of anticipatory bail in FIR No.40 dated 04.04.2019 registered under Section 61/1/14 of the Punjab Excise Act at Police Station Sadar Batala, Police District Batala. The operative part of the order dated 29.04.2019, vide which interim anticipatory bail has been granted to the petitioner, is reproduced as under:- "....Counsel for the petitioner has submitted that the petitioner was not named in the FIR and after the accused - Gurjant Singh was arrested, recovery was effected and on his disclosure statement, the name of the petitioner has been surfaced.

Notice of motion for 13.05.2019...."

CRM-M No.18997 of 2019 Counsel for the State, on instructions from ASI Vijay Kumar, has not disputed the aforesaid fact and submits that the petitioner is no more required for further investigation. In view of the above, this petition is allowed and the interim bail granted to the petitioner vide order dated 29.04.2019 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
