Kewal Singh v. State Of Punjab And Others
IN THE HIGH COURT OF PUNJAB & HARYANA
AT CHANDIGARH CRM-M No. 21831 of 2022 Date of Decision: 19.05.2022 Kewal Singh .......... Petitioner
Versus
State of Punjab and others .......... Respondents CORAM: HON'BLE MR. JUSTICE SURESHWAR THAKUR
Present:
Mr. Ramandeep Singh, Advocate for the petitioner.
Mr. Harpreet S. Multani, Assistant Advocate General, Punjab **** SURESHWAR THAKUR, J. (ORAL) 1.
The prayer is for a direction being made, upon, the official respondents to conduct a taint free investigation into the petition FIR No. 131 of 30.06.2021 (Annexure P-1), registered at Police Station Sadar Khanna, District Khanna.
2.
However, the above prayer survives only if the investigations are underway and would not survive if there is any possibility of either a report under Section 173 of the Cr.P.C. becoming filed, before the learned Magistrate concerned, or if there is a strongest possibility of a closure report being filed, before the learned Magistrate concerned. 3.
Since, the learned State Counsel, on instructions, given to him, by ASI Surjeet Singh, submits that after completion of investigation into petition FIR, rather very shortly a closure report would become instituted, before the learned trial Magistrate concerned. Therefore, when the investigations into the petition FIR are complete. 4.
Consequently, the petition does not survive. The only remedy DINESH KUMAR 2022.05.19 19:06 I attest to the accuracy and authenticity of this document available to the petitioner, is that, after the presentation of the cancellation
CRM-M No. 21831 of 2022 -2report, before the learned Magistrate concerned, to hence make a protest against its acceptance, by him.
