(Oral) Quashing of FIR No. 151 dated 30.08.2012 under Sections 452/323/427/148/149 IPC and rapat No. 34 dated 30.08.2012 registered under Sections 324/427/34 IPC, registered at P.S. Sadar, Fazilka, Distt. Fazilka is being sought on the basis of compromise dated 16.10.2014 (Annexure P-2).

F.I.R and cross version were registered on the statement of the complainant with the allegations that they had given injuries on the complainant. A cross case had also been registered in the above said F.I.R The matter has now been duly compromised, vide compromise deed dated 16.10.2014 (Annexure P-2). In compliance of order dated 13.11.2014, report of District and Sessions Judge, Ferozepur has been received in this regard. As per report, statement of complainant-Vidya Devi and eye witnessrespondent No. 3-Dharampal have been recorded to the effect that they GAURAV 2015.01.15 15:39 I attest to the accuracy and integrity of this document

Crl. Misc. No. M-38768 of 2014 (O&M) -2had compromised the matter with the accused persons and have no grudge against them. They do not want to proceed further against the accused and have no objection, if the present F.I.R be quashed against the petitioners. Statement of petitioners-Jewant Kumar, Radha Rani, Rewant Kumar and Ashwani Kumar have been recorded to the same effect. Ashwanit Kumar (complainant in cross case) had also stated that he had compromised the matter with the complainant-accused. The compromise has been entered voluntarily Consequently, in view of the status report and in view of the judgment of the Hon'ble Supreme Court in the case of Madan Mohan Abbot vs. State of Punjab 2008(2) RCR (Criminal) 429, the law laid down by the Full Bench of this Court in the case of Kulwinder Singh and Ors. vs.

State of Punjab and another 2007(3) RCR (Crl.) 1052, no useful purpose would be served in prolonging the litigation. Accordingly, FIR No. 151 dated 30.08.2012 under Sections 452/323/427/148/149 IPC and rapat No. 34 dated 30.08.2012 registered under Sections 324/427/34 IPC, registered at P.S. Sadar, Fazilka, Distt. Fazilka, is quashed with all consequential proceedings arising therefrom qua both the parties i.e petitioners as well as complainant. The petition stands disposed of.
