(Oral) The present petition has been filed under Section 482 Cr.P.C. seeking direction to respondents No. 1 to 4 to provide protection to the life and liberty to the petitioners at the hands of respondents No. 5 to 9 who are relatives of the petitioner No.1 and not to register any false case against the petitioners on account of their inter caste love marriage.
It has been averred that the date of birth of petitioner No.1 is 05.11.1997 as per copy of the matriculation certificate (Annexure P-1). Petitioner No.2 is also major and his date of birth is 24.02.1993 as per the copy of matriculation certificate (Annexure P-2) and he is working as a salesman with R.K. Wines Pvt. Ltd. at Kaithal and is earning Rs.12,000 to 15,000 per month. The marriage of the petitioners was solemnized on 07.11.2015 according to Hindu rites in Shiv Durga Mandir, SectorNAVEEN NAGPAL 2015.11.10 15:04 I attest to the accuracy and authenticity of this document
CRM-M-38701-2015 19, Panchkula. The affidavit and the photographs of the marriage ceremony are attached as Annexures P-3 and P-4, respectively. The petitioners belong to different caste. The petitioner No.1 belongs to Khati Caste and petitioner No.2 belongs to Jat Community, on account of which the respondents No.5 to 9 are not happy with the marriage. They are apprehensive that the private respondents would interfere in their married life and that their safety, life and liberty is at threat. The petitioners have made representation to respondent No.4 on 08.11.2015 (Annexure P-5) for the protection of their life and liberty at the hands of respondents No.5 to 9.
After hearing counsel for the petitioners and without expressing any opinion on the merits of the case or the validity of the marriage and the age of the petitioners and keeping in view the binding precedent of the Hon'ble Apex Court in Lata Singh Vs. State of U.P. and another 2006(2) SCC (Criminal) 478, the present petition is disposed of with direction to respondents No. 2 to 4 to look into the said issue upon the representation (Annexure P-5) made to respondent No.2 and take necessary action in accordance with law and provide protection, if required.
