This order shall dispose of the aforesaid eight petitions filed on behalf of petitioners Kamla Rani @ Kamla Devi, Madanjit Singh @ Modi @ Madan Singh, Kamaljit Kaur @ Modan, Amandeep @ Amandeep Dhabla, Shekhar Kumar @ Shekhar Dhabla, Rohit Kumar @ Rohit Dhabla, Sanju Rani, Sahil @ Sahil Dhabla and Rakesh Kumar @ Rakesh Dhabla seeking grant of anticipatory bail in respect of aforementioned FIR. 2.
At the time of issuance of notice of motion in CRM-M-20256-2024, the following order was passed on 25.4.2024:
"The petitioner(s) seek grant of anticipatory bail in respect of a case registered vide FIR No.46, dated 26.3.2024 at Police Station City Sunam, District Sangrur, under Sections 306 of Indian Penal Code, wherein offence under Section 34 IPC was added later on. It is a case where one Narinder Singh @ Noni aged about 17 years and 10 months was found hanging from a ceiling fan in his house on 25.3.2024. The FIR was lodged by father of the deceased. It is the case of prosecution that a suicide note was also found, wherein it is alleged that the deceased was committing suicide having been mentally harassed by Madanjeet Singh @ Modi, Kamaljeet Kaur, Kamala Devi, Rakesh Dabala, Sahil Daball, Rohit Dabala, Aman Dabala, Sanju Rani and Indara Basti.
Learned counsel for the petitioner submitted that a perusal of FIR itself suggests that the deceased had suicidal tendencies inasmuch
( 4 ) as even on an earlier occasion, he had attempted to commit suicide. It has been submitted that as many as 9 persons from the neighbourhood have been named by the deceased, who according to the deceased were mentally harassing him, but the details of such mental harassment are not forthcoming.
Learned counsel for the petitioner submitted that some of the accused are ladies and while petitioner - Kamla Rani @ Kamla Devi (in CRM-M-20256-2024) is aged about 62 years, Kamaljit Kaur @ Modan (petitioner No.2 in CRM-M-20291-2024), who is a widow aged about 48 years.

Meanwhile, in the event of arrest, the petitioner(s) be released on interim bail subject to their furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner(s) shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.

Learned State counsel, upon instructions from SI Davinder Singh, has informed that pursuant to interim directions, the petitioners have since joined investigation and they are not required for any custodial interrogation.

Having regard to the aforestated position, wherein the petitioners are stated to have joined investigation and are not required for any custodial interrogation, all the eight petitions are accepted and the interim directions issued by this Court vide order dated 25.4.2024 (in CRM-M-20256-2024), vide order dated 25.4.2024, (in CRM-M-20291-2024), vide common order dated 30.4.2024 (in CRM-M-21362-2024 & CRM-M-21365-2024), vide order dated 6.6.2024 (in CRM-M-29465-2024), vide order dated 9.5.2024 (in CRM-M-21446-2024), vide order dated 16.5.2024 (in CRM-M-21719-2024 ) and vide order dated 1.5.2024 (in CRM-M-21619-2024) are hereby made absolute, subject to the condition that the petitioners shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438(2) Cr.P.C. 6.
