(ORAL) Learned counsel for the petitioner contends that as per Rule 11 (a) (vi) & (viii) of the Government Residences (Chandigarh Administration General Pool) Allotment Rules 1996, if the deceased employee was residing in an earmarked house, his/her family will have to vacate the said earmarked house and a general category house will be allotted to the family as per his/her entitlement. If within three years of the death of the allottee, kin gets a Government job then the kin shall be allotted house of his/her entitlement though on out of turn basis. 2023:PHHC:060612 CWP No.8969 of 2023 -2In view of table attached with Rule 13, in case of death of an allottee, the permissible period of retention of residence is for one year(extendable up to three years in case where the deceased officer/official or his/her dependent does not own a house in Union Territory, Chandigarh, Mohali or Panchkula).
In the present case, no such cause of action has arisen as yet. The reference to the letter dated 13.04.2023 is intra-departmental communication, not addressed to the petitioner in any manner. No final decision has been taken in the said letter.
At this stage, learned counsel for the petitioner wishes to withdraw this petition, however with a liberty to file fresh petition, in case any cause of action accrues to the petitioner in respect of house allotment under the Rules. 28.04.2023 (RAJ MOHAN SINGH) P.Bhatt JUDGE Whether reasoned/speaking?
