(Oral) The present first petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the petitioner in case bearing FIR No.127 dated 08.10.2023 registered under Section 22 [Section 29 added later on] of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Nihal Singh Wala, District Moga.

At the very outset, learned State Counsel contends that all the prosecution witnesses have already been examined and only the crossexamination of two prosecution witnesses remains pending. He further submits that the said cross-examination is required to be conducted by the counsel for the petitioner himself and, therefore, any delay caused in concluding the same cannot enure in the benefit of the petitioner herein. 3.

Without commenting on the merits of the case and taking into consideration the stage of the trial, where the prosecution evidence has already been concluded, I find that no grounds are made out in favour of the petitioner for seeking concession of regular bail.
