Apparently and as is submitted by learned State counsel, on instructions from ASI Charan Singh, out of total 16 witnesses, 10 have been examined and some of the remaining witnesses are formal in nature and likely to be given up. Further more as reflected from the records, on account of missing of police application for recording statement of the victim, matter is being delayed in tracing the missing application.

The learned trial court is directed to take appropriate measures to prove the said application through secondary evidence and be ensured that the matter is expeditiously disposed of by giving short adjournments to record the evidence of the remaining PWs and if necessitated by using coercive means. The trial be disposed of preferably by the end of October, 2018. Criminal Misc. No. M-39782 of 2018 -2In the light of the same, Mr. Harchand Singh Batth, counsel for the petitioner has made statement withdrawing the present petition at this stage, however, reserving the right of the petitioner to approach this Court again by moving fresh bail application in case the trial is not concluded in the light of these directions. Allowed to do so. Dismissed as withdrawn at this stage with the liberty as aforesaid.
