RAMENDRA JAIN, J. (ORAL) Through this second petition under Section 439 Cr.P.C., petitioner-Jagdeep Singh, has prayed for grant of regular bail in case FIR No. 61 dated 03.07.2018 registered under Section 22 of the NDPS Act (Section 29 of the NDPS Act, added subsequently) at Police Station Harike, District Tarn Taran.

According to the prosecution, 1800 Alprazolam tablets and 1000 Tramadol tablets were recovered from the possession of co-accused of petitioner, namely; Balkar Singh, who is none else, but father of the petitioner. Further, on disclosure statement of Balkar Singh, 1380 Alprazolam tablets, 650 Tramazol tables, 200 Narflozacion and Tinedazole tablets and 400 loose white coloured tablets, 600 injections and 59 vials, were also got recovered from their house. CRM-M-18789-2019 -2falsely been implicated in the aforesaid FIR. He is a licenced chemist. He kept the alleged drugs for sale being duly authorized by the Government. Petitioner is in custody since, 18.04.2019. Conclusion of trial may take a long time. No useful purpose would be served by detaining him in jail. Co-accused of the petitioner, namely; Balkar Singh and Preetpal Kaur, have already been enlarged on bail by this Court vide orders of even date i.e. 26.03.2019 (Annexures P-7 and P-8, respectively) passed in CRM-M Nos. 12520 and 12563-2019. Thus, treating the case of the petitioner on the same parity as that of his co-accused, he may also be released on regular bail.

On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner-Jagdeep Singh, is ordered to be released on bail pending trial, if, not required in any other case, on his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
