***** VIKAS BAHL, J (ORAL) This is a civil writ petition filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing the order dated 24.01.2023 (Annexure P-9) passed by respondent No.1/Secretary, Rural Development & Panchayats Punjab, vide which the stay application dated 21.12.2022 filed by the petitioner in Appeal No.153 of 2022 against suspension order dated 24.11.2022 (Annexure P-6), has been dismissed.

Learned State counsel has pointed out that in the present case, the main appeal itself listed for 18.05.2023 and the said appeal can be disposed of expeditiously, within a period of five weeks, from the date of receipt of certified copy of this order.

Learned counsel for the petitioner has submitted that in view of the statement of learned State counsel, the Secretary, Rural Development and Panchayats Department, Punjab-respondent No.1 be directed to decide DINESH BANSAL 2023.04.29 13:55 I attest to the accuracy of this order Chandigarh

CWP-9000-2023 -22023:PHHC:061016 the appeal filed by the petitioner, as expeditiously as possible, preferably within a period of five weeks, from the date of receipt of certified copy of this order. It is prayed that the petitioner be given liberty to raise all the points before the authority concerned.

Learned counsel for the petitioner has further submitted that the petitioner would file an application before respondent No.1 prior to 18.05.2023 with a copy to the respondents bringing into the notice of respondent No.1 the order passed by this Court. Keeping in view the above facts and circumstances of the case, the present petition is disposed of with a direction to respondent No.1Secretary, Rural Development and Panchayats Department, Punjab to decide the appeal filed by the petitioner, as expeditiously as possible, preferably within a period of five weeks, from the date of receipt of certified copy of this order. The petitioner would be permitted to raise all the points, which have been raised in the present petition, before the authority concerned.
