Seeking quashing of the order dated 09.04.2024 passed by the Additional Sessions Judge, Sangrur, petitioner has come up before this Court by filing the present petition.

Counsel for the petitioner submits that his car was stolen and was used in a serious crime and now as per the State counsel, it is a material piece of evidence because of this, he is unable to sell the car, which is loosing its value every passing day. 3.

Counsel for the State submits that evidence involved is serious and in case, petitioner sells the car, they do not know that new purchaser might sell the car to scrap or might destroy it, and they will lose evidence itself, as such, permission should not be granted to sell the car.

At this stage, petitioner's counsel submits that atleast trial be expedited. Although this Court cannot expedite the trial simply because the vehicle's value is involved but it is clarified that it shall be permissible for the petitioner to take all legal remedies for the loss caused to him because of the delay of trial. It is further clarified that in case any of the accused, who are in jail, do not appear and try to delay the trial, the concerned Court shall take steps to cancel their bail in accordance with law. State to also not seek any adjournment.
