Present contempt petition is filed for intentional and willful disobedience of the order dated 10.01.2023 passed by this Court in CWP-292023. 2.

The relevant portion of the order dated 10.01.2023 is reproduced as under:- "2. Mr. R.K.Kapoor, Additional Advocate General, Punjab, representing the State of Punjab admits that the State Government employees are entitled to the grant of benefit of Dearness Allowance @ 119% w.c.f. 01.07.2015. He undertakes that not only the petitioners, but all the other similarly situated employees shall be granted the benefit within a period of three months, from today positively, as there cannot be discrimination between the various identically situated employees.

3. In view of the aforesaid facts, no further order is required to be passed in the writ petition. Hence, the present writ petition is disposed of."

Learned State counsel contends that in compliance of order dated 10.01.2023, short reply by way of an affidavit of Mr. Ajoy Kumar Sinha, IAS, Principal Secretary, Department of Finance, Punjab, Chandigarh dated 01.03.2024 has been filed.

Para 5 to 9 of the affidavit dated 01.03.2024, are reproduced as under:- "5.That, the present petitioners were not party in the CWP 29 of 2023, titled as Kuljeet Singh Vs State of Punjab and others, but as the relief was granted to all the government employees of the State, therefore the present contempt petition has been filed by the other similar employees.

6. That, in pursuance to the judgment passed in the writ petition, the relief has been granted to all the employees through instructions dated 24.05.2023. The Copy of the instructions dated 24.05.2023 is annexed herewith as Annexure-R-1.

7. Thus, compliance of the judgment dated 10.01.23 has been made and for the period mentioned in the writ petition i.e 01.07.2015 to 31.12.2015, the Dearness Allowance has already been released to the employees @ 119%.

8. That, thus in pursuance to the directions of the Hon'ble Court dated 10-01-2023 the Government of Punjab has issued common instructions vide letter dated 24.05.2023 to all the Departments of Government of Punjab to grant the arrear of DA/DR @ 6% from to all the employees and pensioners.

9. That, the answering deponent holds this Hon'ble Court in its highest esteem and can never think of disobeying it orders intentionally or un-intentionally. However, if this Hon'ble Court feels any lapse on the part

-3of the answering deponent, the answering deponent tenders unconditional and unqualified apology for the same and undertakes to take corrective steps as per directions of this Hon'ble Court.

Keeping in view the submission made above, it is, therefore, respectfully prayed that the present contempt petition may kindly be dismissed and the rule qua the answering deponent may kindly be discharged." 5.

A perusal of above shows that order dated 10.01.2023 passed by this Court in CWP-29-2023, has been complied with. This fact is not disputed by learned counsel for the petitioner. 6.

In view of the same, contempt is purged and rule is discharged. 7.

Needless to say that the petitioner can avail the remedy as is available to him in accordance with law to challenge the speaking order dated 01.03.2024.
