The petitioners, who are father-in-law and mother-in-law of deceased Madhu, have approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.49 dated 10.4.2018 at Police Station City Gurdaspur, District Gurdaspur under Sections 304-B and 34 of Indian Penal Code.

The FIR was registered at the instance of Chanchala, mother of deceased, wherein it has been alleged that marriage of her daughter Madhu Bala was solemnized in the year 2015 with Amandeep, son of petitioners. It is alleged that her daughter's husband as well as father-in-law and mother-in-law, however, used to taunt her for having brought less dowry and although they had visited the matrimonial home of her daughter several times and tried to reason out with the accused, but to no avail. ( 2 ) CRM-M-18731-2019 (O&M) they received information that her daughter Madhu Bala had ended her life by consuming poison.

The learned counsel for the petitioners has submitted that vague allegations have been levelled in the FIR and that, in any case, the petitioners have already joined investigation and that infact upon conclusion of investigation the police has filed challan only against the husband of deceased and not against the petitioners.

The aforestated position regarding presentation of challan only against the husband of deceased is not disputed by the learned State counsel. 5.

Having regard to the facts and circumstances and while noticing that the petitioners have already joined investigation, the petition is accepted and the interim directions issued by this Court vide order dated 20.5.2019 are hereby made absolute subject to the condition that the petitioners shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
