The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.260 dated 11.9.2013 registered for the offences under Sections 420 and 120-B IPC at Police Station Civil Lines, Batala, District Batala.
Notice of motion has been issued in this case. Ms. Simsi Dhir Malhotra, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner as well as learned Deputy Advocate General, Punjab appearing for the respondentState and have gone through the record. From the record, I find that the present petitioner Harpreet Singh was on regular bail and he used to appear on each and every date of HARPAL SINGH PARMAR 2015.12.18 17:18 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-38836 of 2015 [2] hearing, but on 12.10.2015 he could not appear before the trial Court as he was suffering from illness and doctor advised him complete bed rest. As the petitioner was already on regular bail and he absented only on 12.10.2015 from the Court as argued due to illness and further in view of the interim order dated 19.11.2015 he has already appeared before the trial Court and has been released on interim bail by the trial Court, no useful purpose will be served by sending the petitioner to custody. Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The interim order dated 19.11.2015 passed by this Court granting interim bail to the petitioner is made absolute. December 17, 2015.
