***** SANDEEP MOUDGIL, J. (ORAL) The jurisdiction of this Court has been invoked under Section 482 Cr.P.C. seeking quashing of FIR No.336 dated 30.12.2002 under Sections 420, 465, 468 and 471 of the Indian Penal Code, 1860, registered at Police Station Division No.4, District Jalandhar, as well as quashing of order dated 16.04.2004, whereby petitioner has been declared as proclaimed offender along with all subsequent proceedings arising therefrom. Today, learned counsel for the petitioner is not available and similar was the situation on the previous date of hearing i.e. 12.08.2024. This Court was supposed to grant last opportunity on 12.08.2024, in the light of no representation on behalf of the petitioner. CRM-M-39751-2016 -2However, today as well, there is no representation on behalf of the petitioner.
A perusal of the case file shows that the petition has been filed in the year 2016 and has not been argued after 09.11.2016, when notice of motion was issued and an interim stay was granted in favour of the petitioner. Thereafter, the matter has been consecutively adjourned on the request of learned counsel for the petitioner. In view of the above, I am of the considered view and convinced with the fact that petitioner is not inclined to pursue the present petition. Hence, no useful purpose would be served by keeping the present petition alive.
In view of the above, present petition is ordered to be dismissed for want of non-prosecution.
