Mr. C.S. Pasricha, learned counsel for the petitioner apart from raising other contentions he has contended that the impugned order dated 03.06.2021 (Annexure P-2) has been passed without affording any opportunity of hearing to the petitioner.

From a perusal of the said order also it appears that though the predecessor Principal Secretary, local Government had heard the petitioner and the other parties on 21.11.2019, however, no hearing was afforded to the petitioner by the incumbent Principal Secretary who passed the order dated 03.06.2021. This is evident from the recital in paragraph No.5 of the order as per which only the revision petitioners and the Executive officer of the Municipal Council, Zirakpur were heard by him.

In view thereof, the order dated 03.06.2021 is set aside. The

CWP-18752-2022 -2matter is remitted to the Principal Secretary, Local Government to pass order afresh in accordance with law.

It is made clear that, we have expressed no opinion on the merits of the matter.
