(ORAL) The allegations against the petitioner-Gurdial Singh in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No. 225 dated 22.09.2012 registered at Police Station City District Kapurthala, under Sections 15, 61, 85 of NDPS Act, are that on 22.09.2012 the petitioner was apprehended and from his conscious possession 1435 kg Poppy husk powder, was recovered.
The contentions of the counsel for the petitioner are that the petitioner is in custody since 22.09.2012 and the investigation and trial is likely to take a long time.
The bail is stoutly opposed on behalf of the State by Mr.P.S.Paul, Deputy Advocate General, Punjab contending that a commercial quantity has been recovered and out of 11 PWs 04 have already been examined and if allowed the bail, the petitioner would influence the witnesses.
