The prayer in the present petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Rajinder Singh @ Rajinder Kumar, son of Faqir Chand, resident of village Bham, Police Station, Chabbewal, District Hoshiarpur, who has been booked for having committed the offences punishable PRASHANT KAPOOR 2015.11.18 13:36 I attest to the accuracy and authenticity of this document

CRM-M-38901-2015 (O&M) under Sections 148, 308, 323 and 325 read with Section 149, IPC, in a case arising out of FIR No. 81, dated 23.6.2015, registered at Police Station, Chabbewal, District Hoshiarpur. Learned counsel contends that the present criminal litigation has arisen between two real brothers; the main injury attracting the mischief of Section 308, IPC, has been attributed to the co-accused of the petitioner; and that the injury attributed to the petitioner is on ear and back, by means of iron rod, on the person of Resham Singh.

I have heard learned counsel for the petitioner and with his able assistance gone through the material available on record.

Despite the fact that the petitioner is real brother of the informant/injured, he (petitioner) had caused injuries by means of Saria (iron rod) on the vital parts of the body of Resham Singh (informant). No ground for grant of anticipatory bail to the petitioner is made out.

Dismissed.
