Dated Police Station Sections 07.03.2023 Vigilance Bureau, 420, 465, 467, 471, 120-B IPC Ferozepur and Sections 7, 7(a) of Prevention of Corruption (Amendement) Act 2018 1.

The petitioner, incarcerated upon his arrest in the FIR captioned above, has come up before this Court under Section 439 of Code of Criminal Procedure, 1973 (CrPC) seeking bail.

Vide order dated 24.07.2023, petitioner was granted interim bail and continuing till date. On 31.08.2023, interim order was continued subject to handing over the affidavit to the State counsel by declaring assets of the petitioner. 3.

Petitioner's counsel states that the petitioner has voluntarily complied with the previous order and handed over the affidavit to the state counsel. 4.

As per custody certificate dated 10.09.2023, petitioner has undergone 04 months & 19 days.

As per the State counsel, allegations are that the petitioner and his conmen demanded bribe for a sum of Rs.6 lacs for providing job of Ticket checker and Rs.4.5 lacs for Gateman. However, the complainant is to be equally blamed for bypassing the normal recruitment process and, through cheating and illegal means, wanting a job for money. After that, he complained. It is a kettle calling the pot black. 7.

Given the fact that the petitioner has handed over the affidavit to the State counsel and custody undergone by the petitioner, interim order dated 24.07.2023 is made absolute. Petition is allowed.
