IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-38961 of 2017 Date of Decision: 30.10.2017 Jagtar Singh ....Petitioner

Versus

State of Punjab ....Respondents CORAM: HON'BLE MR. JUSTICE RAMENDRA JAIN Present: - Mr. L.S. Sidhu, Aodvocate, for the petitioner. Mr. Rana Harjasdeep Singh, AAG, Punjab.

RAMENDRA JAIN, J. (ORAL) This is the second petition under Section 439 Cr.P.C. made for grant of regular bail to petitioner Jagtar Singh in a case arising from FIR No.159 dated 02.10.2014 under Sections 457, 380, 436, 427 and 411 IPC registered at Police Station Baghapurana, District Moga. Learned counsel for the petitioner contends that the instant petition has been filed on new grounds. The points to be raised today were not available to him at the time of dismissal of the earlier petition for grant of regular bail.

Learned State counsel contends that supplementary challan is going to be filed shortly, may be within a week, against the petitioner. Heard.

No new ground is raised in this second bail application. Hence, considering the fact that no new ground has been raised by learned counsel for the petitioner today after rejection of his earlier petition for bail on Ravinder Singh 2017.10.31 10:34 I attest to the accuracy and authenticity of this document 23.08.2017, this petition is dismissed with costs of ` 5,000/- to be deposited

-2CRM-M-38961 of 2017 with the State Legal Services Authority, U.T., Chandigarh, inasmuch as the filing of the instant second bail application in such a short span without any new ground is a gross abuse of the process of law as well as wasting precious time of the Court, which could have been utilised in hearing of some meritorious case.
