This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 116 dated 15.07.2015 under Sections 406, 420, 465, 467, 468, 471, 34 IPC and section 12 of Passport Act added lateron at Police Station Division No. 7, Jalandhar, district Jalandhar. Allegation against the petitioner is that he took more than `15.00 lacs from various persons on the pretext of sending them to South Africa on work permit visa. However, he did not adhere to the promise nor returned the money. Learned counsel for the petitioner submits that petitioner is in custody since 19.07.2015. According to him, investigation has been completed and trial is in progress. Thus, no useful purpose would be served by detaining him in custody any longer.

Learned State counsel has opposed the prayer for bail on the ground that fifteen fake visas were recovered from the AJAY KUMAR 2015.11.27 16:01 I attest to the accuracy and authenticity of this document

CRM M-38915 of 2015 petitioner and he is involved in another case of similar nature. I have heard learned counsel for the parties. However, keeping in view the period of incarceration and the fact that case is triable by Magistrate, I am of the considered view that no useful purpose would be served by detaining the petitioner in custody any longer. Without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner. Accordingly, petition is allowed and petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Jalandhar.
