The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of order dated 28.08.2007 whereby respondent proposed to recover a sum of Rs.1,48,809/- from the petitioner.

The petitioner retired from Indian Army on 31.10.1987. He joined Punjab Police as Constable on 02.01.1989. He retired on 30.06.2007. A dispute erupted with respect to dearness allowance and medical allowance because petitioner was getting pension from Indian Army.

CWP-15179-2007 -2from Punjab Police in 2007 and there was dispute with respect to dearness allowance. There was no lapse on the part of the petitioner. A period of 18 years from the date of retirement has passed away. Considering the efflux of time and amount involved, this Court finds it appropriate to make order dated 27.09.2007 absolute. 4.
