RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Ashok Kumar in a case arising from FIR No.20 dated 09.04.2017 under Section 15 of the Narcotic Drugs and Psychotropic Substances Act registered at Police Station Talwara, District Hoshiarpur.
Learned counsel for the petitioner contends that according to prosecution 53 kgs of fresh poppy husk plants were recovered from the house of the petitioner, which after drying would be less than the commercial quantity i.e. 50 kgs. The petitioner is in custody since 09.04.2017. The trial shall take a long time to its conclusion. No useful purpose would be served by detaining the petitioner in jail. On the other hand, learned State counsel vehemently opposed the prayer for grant of regular bail.
